침해행위로 인하여 그 행위가 없었을 경우 특허권자가 제품을 판매하였을 가격보다 더 낮은 가격에 제품을 판매하게 되어 손해 를 입는 경우

A harm caused by acts of infringement when the patent owner is forced to sell its product at a lower price than it could have sold in the absence of the infringing acts.
